1. About Us and These Terms

Aira Dhaaga ("we", "us", "our") is a partnership firm with its registered address at Villa 4, Palm Village, Koduvazhanga, Puthiya Road Junction, Ernakulam, Kerala, India – 683511. We own and operate www.airadhaaga.com (the "Website"), through which we sell clothing for personal use (the "Products").

These Terms of Service ("Terms") govern your use of the Website and your purchases from us. They apply together with our Privacy Policy, Shipping Policy, and Refund Policy. By browsing the Website or placing an order, you agree to be bound by these documents. If you do not agree, please do not use the Website.

We may update these Terms from time to time. The latest version will always be on this page with its "Last updated" date. If you keep using the Website after a change, you accept the updated Terms.

2. Eligibility

To place an order on the Website, you must be at least 18 years of age and legally competent to enter into a binding contract under applicable Indian law. Persons below 18 years of age may use the Website and place orders only with the involvement and consent of their parent or legal guardian, who shall be responsible for the transaction and agree to these Terms on their behalf, to the extent permitted by applicable law. We reserve the right to refuse or restrict access to our services where an account has previously been suspended or terminated for a violation of these Terms or applicable law.

3. Your Account

You may be asked to create an account to place orders. When you do, you agree to give us true, accurate, current, and complete information and to keep it up to date.

You are responsible for keeping your login details confidential and for everything that happens under your account. If you suspect unauthorised use of your account, please tell us right away at connect@airadhaaga.com. We may suspend or close an account if we believe the information given is false or the account is being misused.

4. Orders and Contract of Sale

Products shown on the Website are an invitation to make an offer, not a binding offer to sell. When you place an order, you are offering to buy the Products. After you order, you will receive an email confirming that we received it (the "Order Confirmation"). This is only an acknowledgement and does not mean we have accepted your order.

A contract of sale is formed only when we dispatch your Products and send you a shipping confirmation email. If your order ships in more than one package, each shipment is treated as a separate contract for the items in it.

All orders depend on stock availability. We may refuse or cancel an order before it ships, for example because of a pricing or listing error, stock issues, suspected fraud, or incorrect details. If we cancel an order after you have paid, we will refund you in full.

You confirm that you are buying the Products for personal use and not for resale. Cancellations and returns are handled under our Refund Policy.

5. Product Information

We try to describe and photograph our Products as accurately as we can. However, colours, textures, and finishes may look slightly different on your screen than in real life, and sizes, measurements, and weights are approximate. Product photos are for guidance. Small variations in handcrafted or hand-finished items are normal and are not defects.

Please read each product description and size guide carefully before ordering, and follow the care instructions provided with your Products.

6. Pricing

• All prices are in Indian Rupees (INR) and include GST unless stated otherwise.
• Prices may change from time to time. Adding an item to your cart does not guarantee its price until you complete your order.
• Delivery charges, if any, are shown at checkout before you pay. For details, see our Shipping Policy.
• If a price is clearly wrong because of an error, we may cancel the order and refund you in full.

7. Payments

You can pay using the options shown at checkout, such as cards, net banking, UPI, wallets, or other methods we offer.

• You must use only payment methods you are legally entitled to use, and the details you give must be correct.
• Payments are processed by third-party payment gateways. We do not store your card details, and their own terms and security policies apply to your transaction.
• If a payment is declined or fails because of your bank or the payment provider, we are not responsible for that. If money is deducted but you receive no Order Confirmation, please contact us at connect@airadhaaga.com with your payment details and we will help resolve it.
• We are not responsible for orders that fail because of network or technical problems outside our control, though we will try to help you resolve any resulting issue.

8. Acceptable Use

You agree not to use the Website to:

• Post or send anything unlawful, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Break any law or encourage others to do so
• Gain unauthorised access to our systems, accounts, or other users' data
• Interfere with or disrupt the Website, its security features, or other people's use of it
• Send spam, viruses, or harmful code
• Collect or track other users' personal information
• Use bots, scrapers, or data-mining tools to copy product listings, descriptions, or prices
• Copy or use our content without permission, or infringe anyone's intellectual property
• Make fraudulent or unauthorised transactions

9. Intellectual Property

Everything on the Website, including the Aira Dhaaga name, logo, designs, photographs, text, graphics, and software, belongs to us or our licensors and is protected by Indian and international intellectual property laws.

You may view and use the Website for your own personal, non-commercial shopping. You may not copy, reproduce, modify, distribute, republish, frame, or commercially use any of our content or branding without our written permission. Any unauthorised use ends the permission we give you to use the Website.

If you post a review, comment, or photo on the Website or tag us on social media, you allow us to display and use it to promote our business, without payment.

10. Third-Party Links and Services

The Website may link to or rely on third-party sites and services, such as payment gateways and courier partners. These are provided for convenience only. We do not control or endorse them and are not responsible for their content or practices. Using them is at your own risk and subject to their own terms.

11. Limitation of Liability

We work to keep the Website and our Products at a high standard, but to the extent permitted by law:

• We are not liable for indirect, special, or consequential losses, such as loss of profit, business, or reputation.
• Our total liability for any claim relating to an order will not be more than the amount you paid for that order.
• We are not responsible for losses caused by events outside our reasonable control (see Section 13).
• We are not responsible for unauthorised access to your account caused by your failure to keep your login details secure.

Nothing in these Terms limits any rights you have under the Consumer Protection Act, 2019 or any other law that cannot be excluded.

12. Indemnity

You agree to compensate us and our partners, employees, and agents for losses, claims, and reasonable costs that result from your breach of these Terms, your misuse of the Website, or your violation of any law or anyone's rights.

13. Events Beyond Our Control

We are not liable for any delay or failure to meet our obligations caused by events beyond our reasonable control. These include natural disasters, fire, flood, epidemics, strikes, riots, war, government orders or restrictions, courier or supplier disruptions, and internet or power failures.

14. Suspension and Termination

You can stop using the Website or close your account at any time by writing to connect@airadhaaga.com. We may suspend or end your access if you break these Terms or misuse the Website, and in other cases we will give you reasonable notice where possible.

Ending your account does not cancel orders already placed or payments you owe, and does not affect rights or liabilities that arose before the account was closed. We may keep some of your data after closure where the law requires, as explained in our Privacy Policy.

15. Grievance Redressal

In line with the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020, you can send any complaint about the Website, our Products, or misuse of the Website to our Grievance Officer:

16. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute arising from them will be subject to the exclusive jurisdiction of the courts at Ernakulam, Kerala.

17. General

• If any part of these Terms is found invalid or unenforceable, the rest will remain in effect.
• If we do not enforce a right straight away, it does not mean we have given it up.
• These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, are the entire agreement between you and us about the Website.
• Nothing in these Terms creates a partnership, agency, or joint venture between you and us.
